| Resumo: | A presente dissertação tem por objeto principal o estudo do direito real de laje, especialmente de sua natureza jurídica e de seu regime jurídico, a partir da Medida Provisória nº 759/16 e, sobretudo, da Lei nº 13.465/17. Também é objeto de estudo, com finalidade preparatória ao estudo do direito real de laje, o regime jurídico geral dos direitos reais e o regime jurídico especial dos direitos reais de propriedade e de superfície. Divide-se o trabalho, assim, em duas partes: a primeira, preparatória ao estudo do direito de laje, e a segunda, onde este é efetivamente estudado. A primeira parte é integrada por quatro capítulos, em que se estudam, sucessivamente, a dogmática geral dos direitos reais, o direito de propriedade sob a perspectiva histórico-jurídica, o direito de propriedade sob a perspectiva dogmático-jurídica e, enfim, o direito de superfície. Este estudo prévio mostra-se essencial à investigação percuciente do direito de laje: o estudo da dogmática geral dos direitos reais, sobretudo ao estudo do regime jurídico do direito de laje; e o estudo do direito de propriedade e do direito de superfície, especialmente ao estudo da natureza jurídica do direito de laje. A segunda parte do trabalho, focada exclusivamente ao direito de laje, por sua vez, é integrada por três capítulos. Nela, primeiramente, delineiam-se considerações introdutórias ao direito de laje para, após, se adentrar na investigação de sua natureza jurídica. Em seguida, estudam-se as principais características do direito de laje, procede-se à sua caracterização e, também, à sua confrontação com outros direitos reais. Enfim, no último capítulo estuda-se minuciosamente o regime jurídico do direito de laje |
| Abstract: | This dissertation has as its main object the study of the real law of slab, especially of its legal nature and its legal regime, from the Provisional Measure nº 759/16 and, above all, of Law nº 13.465/17. It is also object of study, with preparatory law for the study of the real law of slab, the general legal regime of real rights and the special legal regime of real property and surface rights. The work is thus divided into two parts: the first, preparatory to the study of slab law, and the second, where it is studied. The first part is made up of four chapters, in which the general dogmatics of real rights, the right to property from the historical-legal perspective, the right to property from the dogmatic-legal perspective and, finally, the law are studied successively of surface. This previous study is essential to the perceptive investigation of slab law: the study of the general dogmatics of real rights, especially the study of the legal regime of slab law; and the study of property rights and surface rights, especially the study of the legal nature of slab rights. The second part of the work, focused exclusively on the right of slab, in turn, comprises three chapters. In it, mainly, introductory considerations to the slab law are outlined in order, after, to enter into the investigation of its legal nature. Then, the main characteristics of the slab law are studied, its characterization and also its confrontation with other real rights are carried out. Finally, in the last chapter, the legal regime of the slab law is studied in detail |
